Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") governs your use of Band Scrum ("Service"). By using the Service, you agree to comply with this AUP, which is incorporated into our Terms of Service.

2. Permitted Uses

The Service is designed for:

  • Managing band practices, rehearsals, and events
  • Creating and organizing setlists and song libraries
  • Collaborating with band members on musical projects
  • Scheduling and coordinating band activities
  • Storing and sharing band-related documents and media

3. Prohibited Uses

You may not use the Service to:

Illegal Activity

  • Violate any applicable federal, state, local, or international law or regulation
  • Distribute or store content that infringes on any third party's intellectual property rights
  • Facilitate money laundering, terrorist financing, or other financial crimes

Harmful Content

  • Upload, transmit, or distribute content that is defamatory, obscene, abusive, or promotes violence
  • Distribute malware, viruses, or other harmful software
  • Store or transmit content depicting the exploitation or abuse of minors

Abuse of the Service

  • Harass, threaten, stalk, or intimidate other users
  • Impersonate any person or entity, or falsely represent your affiliation
  • Send unsolicited bulk communications (spam) through the Service
  • Use the Service to compile data for marketing purposes unrelated to band management

Technical Abuse

  • Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems
  • Scrape, crawl, or use automated means to access the Service without our written permission
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Circumvent any access controls, rate limits, or security measures
  • Use the Service to conduct denial-of-service attacks or other attacks against third parties
  • Probe, scan, or test the vulnerability of the Service without authorization

Resale and Redistribution

  • Resell, sublicense, or redistribute access to the Service
  • Use the Service to provide a competing product or service
  • Share account credentials with unauthorized third parties

4. Enforcement

Violations of this AUP may result in enforcement actions at our sole discretion, following this escalation process:

  1. Warning — For first-time or minor violations, we will notify you and request corrective action within a specified timeframe.
  2. Temporary Restriction — For repeated or moderate violations, we may temporarily restrict specific features or access to your account.
  3. Suspension — For serious or continued violations, we may suspend your account entirely. You will be notified and given an opportunity to respond.
  4. Termination — For severe violations, repeated offenses after suspension, or violations of law, we may permanently terminate your account without refund.

We reserve the right to skip escalation steps for severe violations that pose immediate harm to the Service, other users, or third parties.

5. Reporting Violations

If you become aware of any violation of this AUP, please report it to abuse@bandscrum.com. Include as much detail as possible, including screenshots or links where applicable. We will investigate all reports and take appropriate action.

6. WARRANTY DISCLAIMER

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

7. LIMITATION OF LIABILITY

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS ACCEPTABLE USE POLICY OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO BAND SCRUM DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

8. BINDING ARBITRATION

ANY DISPUTE ARISING OUT OF OR RELATING TO THIS ACCEPTABLE USE POLICY SHALL BE DETERMINED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") IN ACCORDANCE WITH ITS COMMERCIAL ARBITRATION RULES. THE ARBITRATION SHALL TAKE PLACE IN THE STATE OF MARYLAND. THE ARBITRATOR'S DECISION SHALL BE FINAL AND BINDING.

YOU UNDERSTAND AND AGREE THAT BY ACCEPTING THIS POLICY, YOU AND BAND SCRUM ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION.

9. CLASS ACTION WAIVER

YOU AND BAND SCRUM AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

BY ACCEPTING THIS POLICY, YOU ACKNOWLEDGE THAT YOU HAVE READ THIS CLASS ACTION WAIVER, UNDERSTAND IT, AND AGREE TO BE BOUND BY IT.

10. JURY TRIAL WAIVER

YOU AND BAND SCRUM HEREBY WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO SUE IN COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY.

11. Changes to This Policy

We may update this AUP at any time. Material changes will be communicated with at least 30 days' notice. Your continued use of the Service constitutes acceptance of the updated policy.
